Membership Agreement

This Membership Agreement ("Agreement") is between you and Domain Investor Club ("we," "us," or "our"), based in Omaha, Nebraska, United States. It sets out the terms of your membership and your use of our domain packages and managed resale service. You accept this Agreement when you start a membership or, where presented, by ticking to confirm your acceptance at signup. This Agreement works together with our Terms of Service, Privacy Policy, Cookie Policy, Acceptable Use Policy, and Disclaimer, all of which form part of your agreement with us. If anything here conflicts with the Terms of Service, the Terms of Service govern unless this Agreement clearly states otherwise.

1. Eligibility and Acceptance

By accepting this Agreement, you confirm that you are at least 18 years old, that you can enter into a legally binding contract, that the information you have given us is accurate, and that your use of our services is lawful in your country. If you do not meet these requirements, please do not join.

2. What Membership Gives You

Your membership grants you access to our private domain inventory, your member dashboard, the managed resale service, and member support. Membership is what unlocks the club. On its own it does not assign you any domains; you receive domains when you purchase a package, as described below.

3. Membership Fee and Billing

Membership costs $49.99 per month, billed every three months ($149.97 per quarter) in US dollars. Your membership starts when your first payment is processed and renews automatically at the end of each quarterly term until you cancel. By accepting this Agreement, you authorize us and our payment processors to charge the quarterly fee to your chosen payment method until you cancel. If a payment fails, we may retry it and may suspend your access until payment is made.

4. Cancellation

You may cancel your membership at any time before your next quarterly billing date. Cancellation stops all future charges, and you keep access for the remainder of the period you have already paid for. Fees already paid are not refunded, except where the law that applies to you provides a right that cannot be waived. See our Refund Policy for full details.

5. Domain Packages

Packages are a separate, one-time purchase, available only to members. At the date of this Agreement, the packages are: Starter (2 domains at $425 each, $850 total, 17% commission on a sale), Growth (3 domains at $400 each, $1,200 total, 13% commission on a sale), and Scale (5 domains at $375 each, $1,875 total, 10% commission on a sale). The price shown at the point of purchase is the price that applies to your order.

6. Domain Assignment and Ownership

After your package purchase, we assign domains to you from our vetted inventory and show you each name along with the reasoning behind it. Once assigned, the domains are held for your benefit and are sold only with your approval. While a domain remains under our management as part of the resale service, you agree not to transfer, list, sell, or otherwise dispose of it outside the resale service, since doing so would interfere with active sale efforts. You keep your ownership interest in the assigned domains, subject to this Agreement and the Terms of Service.

7. The Managed Resale Service

We value, list, market, and negotiate the sale of your assigned domains, handle all communication with buyers, and manage the secure transfer and collection of funds when a sale closes. We aim to complete a sale within twelve months of assignment. We do not guarantee that any domain will sell, that a sale will happen within any particular time, or that it will sell at any particular price, because those things depend on buyer demand that is outside our control.

8. Your Approval on Every Sale

No domain is sold without your approval on the final price. When a sale reaches a final number, we present it to you through your dashboard or another agreed method, and you may accept or decline it. If you do not respond, we will not close the sale. You agree to keep your contact and payout details current so we can reach you about offers and payments.

9. Commission and Payouts

When one of your domains sells, we retain the commission for your package (17% for Starter, 13% for Growth, 10% for Scale), and the remainder is paid to you in US dollars after the sale completes and funds clear. Commission is charged only on a completed sale. If a domain does not sell, no commission is charged on it. You are responsible for giving us accurate payout details.

10. Renewals

We aim to sell each domain within twelve months. If a domain has not sold within that period, you may choose to keep it on the market by renewing it for $50. Renewal is optional, you decide whether to do it, and we never charge renewal fees automatically.

11. Taxes and Charges

All fees, purchases, and payouts are in US dollars. You are responsible for any taxes, duties, currency conversion costs, or bank charges that apply to you under your local law, and for reporting and paying any taxes due on amounts you receive. We are not responsible for fees charged by your payment provider or bank.

12. Risk Acknowledgment

You understand and accept that domain investing carries risk. A domain may take the full year to sell, may sell for less than you hoped, or may not sell at all. You accept that we do not promise any profit, sale, or specific return, that any figures or examples on our website are illustrations rather than promises, and that you should not commit money you cannot afford to leave tied up while a sale is sought. 13. Your Obligations

You agree to use the services lawfully and in good faith, to follow our Acceptable Use Policy, to keep your login secure, to give accurate information, and not to attempt to bypass the resale service or interfere with the platform. Breaking these obligations may lead to suspension or termination, as set out in the Terms of Service.

14. Suspension and Termination

You may end this Agreement by cancelling your membership. We may suspend or end it if you breach this Agreement, the Terms of Service, or the Acceptable Use Policy, provide false information, or use the services unlawfully. On termination, any commission owed on sales already completed remains payable, and the terms that by their nature should survive will continue to apply. Termination of membership does not by itself force the sale of your assigned domains, and we will explain the options for any domains under management at that time.

15. Changes to This Agreement

We may update this Agreement from time to time. When we do, we will revise the "Last updated" date above and, where the changes are significant, take reasonable steps to notify you. Continuing your membership after a change takes effect means you accept the updated Agreement. If you do not accept a change, you may cancel your membership.

16. How This Agreement Fits With Our Other Terms

This Agreement should be read together with our Terms of Service, Privacy Policy, Cookie Policy, Acceptable Use Policy, and Disclaimer. Together they form the full agreement between you and us about your membership and use of the services.

17. Governing Law and Disputes

This Agreement is governed by the laws of the State of Nebraska, United States, without regard to its conflict-of-law rules. We ask that you contact us first to resolve any concern directly. Any dispute that cannot be resolved informally will be handled as set out in the Terms of Service, including the arbitration and local-rights terms there.
